Terms of service

Last updated: October 2026  ·  Crossmarc, LLC

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Crossmarc Steward platform (the "Service"), operated by Crossmarc, LLC, a Colorado limited liability company ("Crossmarc," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.

2. Accounts

You must be at least 18 years old to create an account. You are responsible for all activity that occurs under your account. Keep your credentials confidential. Notify us immediately at security@steward.crossmarc.com if you suspect unauthorized access.

One person or legal entity may not maintain more than one free trial simultaneously. Accounts created for the purpose of circumventing plan limits may be terminated.

3. Acceptable use

You may use Steward only for lawful purposes. You agree not to:

  • Use the Service to store, transmit, or display content that is unlawful, fraudulent, or violates any applicable law or regulation;
  • Store payment card data anywhere in the Service, including the credential vault, notes, and uploaded documents. Payment card data means full credit or debit card numbers, card security codes, and PINs. The Service is not intended to hold payment card data;
  • Attempt to access accounts or data belonging to other users without authorization;
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service;
  • Use the Service in any manner that could damage, disable, or impair its operation or servers;
  • Resell, sublicense, or otherwise make the Service available to third parties on a commercial basis without our prior written consent;
  • Use the Service to conduct activities that constitute financial crimes including money laundering or securities fraud.

4. Billing and payment

Paid plans are billed in advance on a monthly or annual basis. Billing is handled by Stripe. By subscribing, you authorize Crossmarc (through Stripe) to charge your payment method on the recurring basis you select.

Free trials are available on the Establish and Entrust plans. At the end of the trial period your chosen payment method will be charged unless you cancel before the trial expires.

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. We do not issue refunds for partial billing periods, except where required by applicable law.

If a payment fails, we will notify you by email and provide a grace period to update your payment method. Accounts that remain unpaid after the grace period may be suspended.

5. Your content

You retain all ownership of the content you upload to Steward, including documents, entity records, notes, and account data. You grant Crossmarc a limited, non-exclusive license to store and process your content solely for the purpose of providing the Service to you.

You are responsible for ensuring that the content you upload does not violate the intellectual property rights or privacy rights of any third party.

6. Data and privacy

Our use of your personal and financial information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell your data. We do not use it to train models.

7. AI-generated content

Steward includes an optional AI assistant. Its responses are generated by a machine-learning model and may be inaccurate, incomplete, or out of date, including figures, totals, and summaries of your own data. Assistant responses are provided for convenience and informational purposes only; they are not financial, investment, legal, tax, or accounting advice, and you should not rely on them as a substitute for the underlying records in your workspace or for advice from a qualified professional. You are responsible for verifying any assistant output before acting on it. Assistant usage is subject to the monthly allowance of your subscription tier.

As between you and Crossmarc, you own the responses the assistant generates from your data; we claim no rights in them. We may modify, substitute, or discontinue the underlying AI technology or the assistant feature at any time, provided the data-handling commitments in our Privacy Policy continue to apply.

8. Disclaimers

No financial advice. Steward is a data organization and record-keeping tool. Nothing in the Service constitutes financial, investment, tax, or legal advice. We do not make recommendations about any asset, institution, or strategy. You should consult qualified professionals for advice specific to your situation.

Service availability. We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranty of any kind, express or implied.

Data accuracy. Account data is retrieved from third-party institutions through Plaid. We are not responsible for inaccuracies in data provided by those institutions or by Plaid.

Property valuations and estimates. Where you enable automated valuation for a real-estate asset, estimated market values are generated by a third-party automated valuation model from the property address you provide. These estimates are stated in terms of probability based on market data and available public records; they are not certified appraisals, opinions of value, or investment advice, and are not guaranteed. They may be inaccurate (public assessor and property records do not always reflect recent additions or modifications to a property) and should not be relied upon as the sole basis for any financial decision. No advisory, fiduciary, or other relationship is created by the provision or use of these estimates.

9. Limitation of liability

To the maximum extent permitted by applicable law, Crossmarc's total liability to you for any claims arising from your use of the Service will not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.

In no event will Crossmarc be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

10. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Crossmarc and its members, officers, employees, and agents from and against any claim, demand, or proceeding brought by a third party, and any resulting damages, liabilities, costs, and expenses (including reasonable attorneys' fees), to the extent it arises from:

  • Content you upload to or record in the Service, including a claim that it infringes or violates the intellectual property, privacy, or other rights of a third party, or that you did not have the right or authority to share it;
  • Your breach of these Terms;
  • Your violation of any applicable law or regulation;
  • The actions of anyone you invite or permit to access your account or workspace;
  • Your use of the Service on behalf of another person or entity without that person's or entity's authority.

This obligation does not apply to the extent a claim results from Crossmarc's own breach of these Terms, negligence, or willful misconduct.

We will notify you promptly of any claim we believe is covered by this section and give you reasonable cooperation in defending it, at your expense. We may take part in the defense with counsel of our own choosing, at our own cost. You may not settle a claim in a way that admits fault on our behalf or places any obligation on us without our prior written consent.

This section continues to apply after your account is closed or these Terms end.

11. Termination

You can manage or cancel your subscription at any time. We may suspend or terminate your account for material breach of these Terms, with notice where practicable.

When your subscription ends, your account is suspended. If you do not reactivate your subscription, we may mark your account and all its data for permanent deletion after a period of suspension.

12. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms will be resolved in the state or federal courts located in Colorado, and you consent to personal jurisdiction in those courts.

13. General

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and Crossmarc about the Service, and they replace any earlier understanding on the same subject. If you or your organization has signed a separate written agreement with Crossmarc that covers the Service, that agreement controls where the two conflict.

Severability. If any part of these Terms is found unenforceable, that part will be enforced to the greatest extent permitted, and the rest of these Terms will remain in effect.

No waiver. If we do not enforce a part of these Terms in one instance, we have not given up the right to enforce it later.

Assignment. You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer ours in connection with a merger, acquisition, or sale of all or substantially all of our assets, provided the successor honors these Terms and our Privacy Policy, and we will notify you by email if that happens.
